4. Intellectual Property

The OFFWAN name, associated logo, and the overall structure, software, graphic design, and content of the website and mobile applications (excluding content submitted by Members) are the exclusive property of CARL HIVE and are protected under French and international intellectual property law, in particular the French Intellectual Property Code (Code de la propriété intellectuelle).

Any reproduction, representation, modification, or exploitation of all or part of these elements, by any means whatsoever, without the prior written authorization of CARL HIVE, is strictly prohibited and may constitute an infringement (contrefaçon) sanctioned under Articles L335-2 et seq. of the French Intellectual Property Code.

5. Consumer Mediation

In accordance with Directive 2013/11/EU on alternative dispute resolution for consumer disputes and Articles L616-1 et seq. of the French Consumer Code, any Member qualifying as a consumer has the right to refer, free of charge, to a consumer mediator in the event of a dispute with CARL HIVE that has not been resolved through a prior written complaint.
